House of E Records, LLC (“we”, ”us”, “our”) takes your privacy to heart. In this Privacy Policy we explain just how we collect, use, and disclose the information collected from your use of our websites, online and offline services, emails, and your use of any House of E Records, LLC website or online platform that displays a link to this Privacy Policy (referred to “Site” or “Sites” throughout this policy). This Privacy Policy will also describe how House of E Records, LLC, our labels, affiliates, agents, subsidiaries, partners (together referred to as “House of E Records, LLC”) may use the information collected across the Sites. When this Privacy Policy uses the term “personal information,” it means information that identifies you or that is reasonably capable of identifying or being related to you. Personal information also includes your full name, street address, telephone number or email address.

I. How We Collect Your Personal Information

When you visit or use our Sites, we automatically collect information directly from you and sometimes from third parties. While these codes do not identify you directly, they may be used to connect your activity and interests. We will treat de-identified or pseudonymized information as non-personal to the fullest extent allowed by law.

We may collect the types of personal information listed below:

  • Contact details like your full name, email address, residential or mailing address, and telephone or mobile phone number;
  • Transaction and billing details, including billing address, purchase history, order details, and other commercial data;
  • Demographic data, such as age, date of birth, gender, interests, country of dwelling or residence, and zip code;
  • Payment details, like credit card, debit card, or other information related to payment;
  • Unique online identifiers, such as account credentials (including username and password), and your device’s Internet Protocol (IP) address;
  • Preferences and other information, such as product wish lists, order history and marketing & music preferences;
  • Geolocation information, such as your estimated location (for instance, from the IP address of your device or computer);
  • Images, videos and other content that you share on our Sites, which may include technical data (like “metadata”) that may disclose details about the content, such as the time and location it was created;
  • Photos, videos (including videos featuring audio), or audio recordings taken at events we host or arrange (or that are hosted for us) that may show or include you (including your name, image, and/or likeness).
  • Internet and other electronic network activity information; and
  • Additional information you choose to provide to us in a request, including but not limited to your health information as related to access or special requirement requests at our events or productions or events or productions hosted by a third party on our behalf.

Are you an independent artist or label using our client-facing Site(s), services, tools or apps? In some cases, we may collect these additional categories of personal information about you:

  • Business identifiers, such as your trade or House of E Records, LLC name, and any applicable registration or House of E Records, LLC number;
  • Contact details for authorized individuals, such as representatives and/or employees, including names, email addresses, mailing or physical addresses, and telephone and/or mobile phone numbers;
  • Payment and accounts payable details, which may include bank account details and applicable tax forms;
  • Limited term identification documents, such as passport or driving license, and proof of address such as utility bills or credit card statements;
  • Details contained on identification records, such as nationality, gender, date of birth, place of birth;
  • Social Security number (or similar documents);
  • Signatures, including those of you, your authorized representative(s), or witnesses; and
  • Contact details as provided on applicable registration certificates for you or your authorized representative’s.

Further, whenever you visit or interact with the Sites, House of E Records, LLC as well as our third-party analytics and advertising providers or other service providers may use various technologies that automatically or passively collect information about how the Sites are accessed and used, as further explained in the Tracking Technologies section

II. How We Use Information Collected from Sources Other Than You

If we receive information about you from other sources, we may consolidate this data with information we already have about you, including:

  • Artists, including promotional or marketing information received from a new or partner artists that may be combined with your existing information to personalize fan experience;
  • Business Partners, including companies that help run promotions and contests, process payments, deliver technical services, analyze usage, advertise, and/or enable log in and social media/network features;
  • Information from publicly available databases;
  • Other platforms, including music or video streaming sites and social media platforms;
  • Connected Digital Service Providers: Certain features on our Sites may allow you to connect your online profiles (including your social media accounts)—if you use these features, we may collect the information that you permit through those connected account settings; and
  • Information you provide in public community forums: We may offer message boards, chat rooms, games in our Sites or artist, podcast, and product pages on third party platforms (collectively, “Community Forums”) where you can network, communicate with others, submit photographs, writings, music, video, audio recordings, computer graphics, pictures, data, questions, comments, suggestions or other content (together referred to as “User Submissions”).

We can use this data to refresh, grow and interpret our records, find new customers and provide content and services that you may find interesting.

III. How We Use Your Personal Information

We (or our partners) can use this information for these business reasons:

  • To send you updates and/or newsletters about an artist, podcast, music genre or related special offers, as requested by you;
  • Share information about products or services you have requested;
  • Fulfill your order;
  • Send you an order confirmation;
  • Respond to customer service requests, questions and concerns;
  • Administer your account, including managing your preference center;
  • Send you marketing communications and display online advertising;
  • Administer promotions and sweepstakes you enter and communicate with you about the results;
  • Enhance our marketing and advertising efforts;
  • Maintain and enhance our Sites, content, products and services;
  • Analyze and research;
  • Display or promote content and advertising based upon your location and/or interests;
  • Provide location services like “tagging” and “check-in”;
  • Maintain the security and effective functioning of our Sites and your accounts;
  • Meet contractual obligations and enforce our rights and remedies under agreements; and
  • Meet legal or regulatory requirements and exercise our legal rights.

If you share personal information about your contacts, we will only use this information for the specific purpose for which it is provided.

IV. Social Networks/Online Communities

Third Party Widgets: Our Site(s) may display small embedded applications provided by third parties, often called “widgets,” that deliver specific services—such as streaming music, displaying social media feeds, or enabling content sharing or “likes.” If you interact with a widget, you may be asked to provide personal information (for example, your email address), which may be collected directly through that feature. Widgets may also use cookies or similar technologies to gather information about your browsing activity, including clickstream and usage data. Any information collected though a widget is subject to the privacy policy of the House of E Records, LLC that created it, rather than this Privacy Policy

V. Purchases and Subscriptions

Certain products and services—such as music, podcast subscriptions, or merchandise—may be available for purchase through our Sites or through websites associated with our artists or podcasts. In some cases, completing your transaction will require you to leave our Site and proceed to a third-party platform that hosts the checkout process.

When this occurs, the external site will be clearly identified and will provide its own privacy policy, indicating that the third party—not us—is responsible for collecting and processing your personal information in connection with the transaction. We encourage you to review that third party’s privacy notice if you have questions about how your information will be handled.

VI. Monitoring Information to Prevent Fraud

We take steps to safeguard our Sites, users, and business operations. As part of these efforts, we may monitor activity (including by collecting, recording, and analyzing online activity or communications) on the Sites and use the information we collect—including personal information—to detect and prevent fraud, misuse of the Sites, and other unauthorized or unlawful conduct. This may include reviewing activity to identify suspicious transactions, enforcing our Terms of Service and this Privacy Policy, investigating potential violations, and protecting the rights, property, and safety of House of E Records, LLC, its partners, and its customers. By accessing or using the Sites, you acknowledge and agree to this monitoring. If you do not agree to these practices, you should discontinue use of the Sites.

We keep your information for as long as your account remains active or as otherwise necessary to provide requested services and carry out the purposes for which the information was collected.

We may also retain and use your information for a longer period where required to meet legal or regulatory obligations, resolve disputes, enforce our contractual rights.

We may share personal information with third-party service providers that perform functions on our behalf, such as fulfilling orders, handling shipping, supporting Site operations, providing customer support, distributing email communications, or assisting with marketing and advertising initiatives.   • Representatives of our recording artists, including managers, labels, podcast partners, and other trusted collaborators;
  • Independent artist or label clients—such as labels distributing content through a House of E Records, LLC–owned platform—where disclosure supports marketing or promotional activities;
  • Third-party vendors and service providers that assist with functions such as website hosting, email distribution, analytics, and related operational services;
  • Business partners whose products or services may be of interest to you, where you have provided prior consent;
  • With former House of E Records, LLC recording artists or their representatives;
  • Where required by law, such as to comply with a subpoena or similar legal process;
  • When we have a good faith belief that disclosure is needed to protect our rights, protect your safety or the safety of others, investigate fraud or respond to a government request;
  • In relation with corporate changes including a mergers, acquisitions or sales of assets;
  • To any other party with your prior consent or otherwise at your direction; and
  • With applicable collection societies if you are an independent artist or label client and direct us to do so.

IX. Your Choices & Preferences

Email and Newsletter Preferences

You may opt out of receiving promotional emails, newsletters, or updates from us at any time. To do so, you can use the unsubscribe link provided in our marketing emails or select the “Manage Your Preferences” option included in those communications to update your selections through our preference center.

Depending on the Site, you may also be able to modify your communication settings by logging into your account profile. Alternatively, you may contact us directly at privacy@hermanosespinozaoficial.com to request changes to your email preferences.

Mobile Marketing

If you choose to join our mobile marketing program, please note that standard messaging rates or data charges may apply according to your wireless carrier and plan. We recommend checking with your carrier before signing up to receive SMS (text) or MMS (multimedia) messages.

To stop receiving mobile messages from us or on our behalf, you can reply with “STOP” to any message. You may also contact your wireless provider for additional guidance on managing or stopping mobile communications.

From time to time, we may send push notifications to keep you informed about events, promotions, or other updates. You can disable these notifications directly through your device or application settings, as applicable. To deliver these notifications effectively, we may need to collect certain information about your device, including operating system details and device identifiers.

Updating Your Account Information

We will respond to your requests within a reasonable timeframe in accordance with applicable laws.

X. Location

Note that some of the information we collect from your device includes information about where you are located. We gather this information by using IP address, GPS or Wi-Fi, among other technologies. You may be able to opt-out of further sharing your location with us by changing your device settings or by uninstalling our application. Some mobile service providers may also provide us or our service providers with information regarding the physical location of a device used to access the Sites.

XI. Tracking Technologies

We use tools like cookies and pixel tags to automatically or passively collect information that tracks your visits, preferences, and profile information as you interact with our Sites. This includes connection information (such as the domain name and Internet Service Provider), browser type and version, mobile device ID, cell phone carrier, operating system and type of device, average time spent on our Site(s), pages viewed, traffic to and from the websites, information accessed, the IP address you use to connect to the Internet and related geographical information about your computer or mobile device, and advertising data and other standard weblog information. This information is sometimes referred to as web analytics and/or clickstream data. The technologies used to collect this information include:

  1. Cookies are text files that are stored locally on your device when you visit a website. We use them to acquire data about user tastes and activity (including how you use our Sites, and when you access our Sites). We also use them, and technologies like them, to enhance our Sites and to deliver a superior, personalized experience. To this end, we use Cookies and similar technologies to study Site traffic patterns, enable features, send SMS notifications related to Site use, and to gage the impact of our communications.
  2. “Pixel Tags” (also known as image tags, web beacons, single-pixel images, tracer tags, GIFS or web bugs) are small pieces of code. Among other things, they collect usage analytics data, by counting page views, promotion views or advertising responses. Pixel tags or similar technologies are used in a multi-purpose fashion, including, without limitation, to count Site visitors, to monitor user Site navigation, to count the number of opened emails, and to count the number of content views of sent content.
  3. Embedded Scripts are programming codes that collect information about your Site interaction, including information about the links you click on. This code is downloaded temporarily onto your device from our server or a third-party service provider, is active only while you are connected to the Sites, and is deactivated or deleted thereafter.
  4. Information Collected from Mobile Devices. If you access our Sites using a mobile device, we or third-party providers will receive usage information about that device. This includes information about the type of device and the device identifier, as well as other usage information, including through SDKs. SDKs are software packages that contain tools that can be used to create apps and integrate new app features. We use embedded scripts and the tools provided in SDKs to gather data from mobile devices such as the hardware model, operating system and version, identification numbers assigned to your mobile device, such as the ID for Advertising (IDFA) on Apple devices, and the Advertising ID on Android devices, mobile network data, and website usage behavior. We may utilize usage information to track your Site use. Contact your mobile service provider or device manufacturer for instructions on changing these settings.

The information gathered from cookies and similar technologies make our Sites easier to navigate, improve our advertising and to provide you with a more personal and convenient experience. We may use this information to remember your selected preferences and/or to provide you with personalized advertisements related to your interests on our Sites and others and across your devices. XII. Third Party Advertising/Analytics and Managing Tracking Technology Preferences

House of E Records, LLC works with third parties (such as network advertisers, ad agencies and other advertising partners) to advertise online. We also use analytics providers to provide us with information regarding the use of the Sites and the success of our advertisements. You may also see third party ads on the Sites. These third parties may utilize their own tracking technologies on your device (including cookies, and pixel tags), and they may otherwise collect or have access to information about you, some of which may be personal information or personal data under various state laws. Some of these parties may collect personal information over time when you visit the Sites or other online websites and services. We may share non-personal information, including information that has been hashed (including hashed email addresses) or otherwise de-identified, pseudonymized, and non-precise location information, with third party advertising companies, analytics providers and other third parties, including for the purpose of serving you more relevant ads.

We may work with Google Analytics. Google Analytics uses cookies and similar technologies to collect and analyze information about use of the Sites and report on activities and trends. We work with a number of advertising service providers to display ads. Some of these providers participate in industry self-regulatory programs, such as the Network Advertising Initiative (NAI) and the Digital Advertising Alliance (DAA). These organizations offer tools that allow you to opt out of interest-based advertising from participating companies. Depending on your device, you may also adjust your mobile settings to limit interest-based advertising, including restricting the use of advertising identifiers. Please note that opting out of interest-based advertising does not eliminate advertising altogether. You will continue to see advertisements online, but they may be less personalized. Certain web browsers include a “Do Not Track” (DNT) setting that allows you to signal your preference not to have your online activity monitored. Global Privacy Control (GPC) is a browser-based setting that allows you to communicate your preferences regarding certain types of third-party tracking automatically. Please note that choosing to opt out of tracking technologies or targeted advertising cookies will not eliminate advertisements entirely. You will continue to see ads online; however, they may be less tailored to your browsing activity.

House of E Records, LLC adheres to generally accepted industry standards to protect your personal information, both during transmission and after receipt. You should be aware transmissions of personal information over the Internet and methods of storing personal information over the Internet are not completely secure and we cannot guarantee its absolute security. Our Sites are hosted, managed, and operated in the United States. XVI. Children’s Privacy

The Sites are a general audience website and are not directed to children under the age of 13. We do not knowingly collect or attempt to collect any personal information from children under the age of 13. Your Rights

Access Your Information / Obtain Your Information / Data Portability. You have the right to request confirmation of whether we are processing your personal information and request to access that information. As legally required, this may include the right to receive a copy of your personal information, and if feasible and permitted by law, in a readily usable format to allow data portability. For certain states, this may include a list of third parties with whom we have shared personal information;

Correct. The right to request that we correct inaccurate personal information we hold about you;

Delete. The right to request that we delete the personal information we hold about you;

Opt-out out of Sale and Targeted Advertising. You have the right to opt out of the “sale” of your personal information or processing of your personal information for targeted advertising, as defined by the applicable state law. While House of E Records, LLC does not sell Personal Data to third parties for monetary compensation, we participate in online advertising practices (and certain analytics or similar activities) that may be considered a “sale” or “targeted advertising”. You may disable sharing through cookies set by third parties that may be considered a “sale” or targeted advertising, by referencing the “Manage Cookies” link in our Sites’ respective cookie banners. Right to Opt-Out of Profiling in furtherance of legal or similarly significant effects. Certain state laws grant individuals the right to opt out of profiling, as defined by applicable law, that produces legal effects or other similarly significant consequences. House of E Records, LLC does not engage in profiling activities that result in legal or similarly significant effects on individuals. As a result, this opt-out right is not applicable and is not offered at this time.

Right to Appeal. You have the right to appeal decisions relating to your request by contacting us at privacy@hermanosespinozaoficial.com.

B. Notice to Nevada Residents:

If you reside in Nevada, you have the right to opt out of the sale of certain personally identifiable information (PII) that we may collect. Currently, House of E Records, LLC does not sell your PII as defined under Nevada law.

Should we engage in such a sale in the future, Nevada residents may submit an opt-out request in writing to privacy@hermanosespinozaoficial.com.

This California Privacy Notice supplements our Privacy Policy and is only for California Consumers. This notice details the rights that California Consumers enjoy regarding their personal information and conforms applicable law, including without limitation the California Consumer Privacy Act as amended by the California Privacy Rights Act and any implementing regulations adopted thereunder (“CCPA”). Terms (including defined capitalized terms) used in this California section of this Privacy Policy have the same meanings given in the CCPA, unless otherwise defined.

California Consumer Rights

California residents have the following rights, subject to applicable exceptions:

Knowledge. On receipt of a verifiable request, you may request information about what personal information we collect, use, or disclose, and other information about our data practices, including the categories and/or specific pieces of personal information we have collected about you, and the categories of sources of such personal information and the categories of third parties to whom we disclose such personal information.

Deletion. You have the right to request –via verifiable request—that we delete your personal information from our records;

  • Please note that we may not delete your personal information if it is reasonably needed to:
    • Complete the transaction for which the information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with Federal Law, provide a good or service requested by you, or reasonably anticipated withing the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
    • Help to ensure security and integrity to the extent the use of the consumer’s personal information is reasonably necessary and proportionate for those purposes;
    • Debug to identify and repair errors that impair existing intended functionality;

Correction. Request—via verified request—correction of inaccurate personal information we have about you; and

Opt-Out of the Sale or Sharing of Personal Information. You may request to opt out of the “sale” or the “sharing” of your personal information to third parties for cross-context behavioral advertising (i.e. targeted advertising). We do not knowingly sell or share personal information of residents younger than the age of 18 for cross-contextual behavioral advertising their personal information.

Limit the Use and Disclosure of Sensitive Personal Information. Under the CCPA, a business must only provide the Right to Limit the Use and Disclosure of Sensitive Personal Information when Sensitive Personal Information is collected or processed for the purpose of inferring characteristics about a consumer or does not fall under certain statutory exceptions. House of E Records, LLC’s use and disclosure of Sensitive Personal Information falls within the statutory exceptions; therefore, we do not currently offer this right.

Non-Discrimination. We will not discriminate against you for exercising your CCPA rights by:

  • Denying goods or services to you;
